Housing (Cladding Remediation) (Scotland) Act
The Bill gives powers to Scottish Ministers to assess and remediate certain types of buildings with unsafe cladding. Scottish Ministers will need to record these assessments and any remediation works completed in a register. The Bill also allows Scottish Ministers to create a responsible developers scheme. The bill became an Act on 21 June 2024 therefore all the powers involved sit with Scottish Ministers. Work on implementation has been underway for some time and will now be captured by the legal process and Scottish Ministers have approached COSLA with a view to discussing any issues that may arise for local authorities.
Colleagues in planning and Building Standards will have a role, it’s much less clear to what extent housing services will be involved either as owners of affected buildings or in supporting the delivery process.
