Rent Adjudication (Temporary Modifications) (Scotland) Regulations 2024 – Business and Regulatory Impact Assessment
The Scottish Government published the BRIA on the 5th February 2024 to support the transition away from the rent cap, and proptect tenants from excessively large rent increases which could be experienced if there is a sudden move to open market rent levels that have been supressed.
The report demonstrates the difficulties in measuring impacts across a sector that is both diverse and not very well covered by reliable data. The high-end estimate is that 660 tenants may take advantage of the protections against excessive rent rises, which equates to around 0.2% of tenants. The paper concludes that there is no risk of any increase in opportunities for “unscrupulous suppliers” to target consumers.
